Welcome to Adventure Fishing Lanka. These Terms and Conditions outline the rules and regulations for the use of our website (https://adventurefishinglanka.com/) and the booking of our fishing charters, tours, and related services.

By accessing this website and booking a trip with us, you accept these terms and conditions in full. Do not continue to use our services if you do not agree to all the terms stated on this page.

1. General Provisions

  • Company: “Adventure Fishing Lanka”, “we”, “our”, and “us” refers to the business operating the website and services.

  • Customer: “You”, “your”, “guest”, and “passenger” refers to the individual booking the service and all members of their party.

  • Eligibility: You must be at least 18 years of age to book a charter. Minors must be accompanied by a parent or legal guardian at all times during the trip.

2. Booking, Payments, and Cancellations

  • Deposits: A deposit of [Insert Percentage, e.g., 30%] is required at the time of booking to secure your reservation. The remaining balance is due [Insert timeframe, e.g., prior to departure / 7 days before the trip].

  • Cancellations by Customer:

    • Cancellations made [Insert Days, e.g., 14 days] or more before the scheduled trip will receive a full refund of the deposit.

    • No-shows will be charged the full amount of the booked trip.

  • Cancellations by Us: We reserve the right to cancel any trip due to mechanical issues, staff illness, or unforeseen circumstances. In such cases, we will offer to reschedule your trip or provide a full refund.

3. Weather and Sea Conditions

  • Captain’s Discretion: The safety of our guests and crew is our top priority. The Captain reserves the right to cancel, delay, or alter the course of the trip due to severe weather, high seas, or any other unsafe conditions.

  • Weather Cancellations: If your trip is canceled by the Captain prior to departure due to unsafe weather, you will be given the option to reschedule or receive a full refund.

  • Shortened Trips: If the weather turns hazardous during the trip and the Captain decides to return to port early for safety reasons, partial refunds will be determined on a case-by-case basis.

4. Safety, Conduct, and Captain’s Authority

  • Authority on Board: The Captain has ultimate authority on the vessel at all times. Guests must comply with all instructions given by the Captain and crew.

  • Prohibited Items: Illegal drugs, firearms, and hazardous materials are strictly prohibited on board.

  • Alcohol: [Select one: Alcohol is not permitted / Moderate consumption of alcohol is permitted for guests of legal drinking age]. The Captain reserves the right to terminate the trip without refund if any guest becomes heavily intoxicated, disruptive, or poses a safety risk.

  • Termination of Trip: If the Captain ends the trip early due to passenger misconduct, violation of safety rules, or illegal activities, no refunds will be issued.

5. Assumption of Risk and Liability

  • Inherent Risks: Fishing and boating involve inherent physical risks, including but not limited to slippery decks, unpredictable weather, rough water, and handling sharp hooks and wild fish. By booking a trip, you acknowledge and voluntarily assume all such risks.

  • Medical Conditions: Guests are responsible for informing the crew of any severe medical conditions, allergies, or physical limitations prior to departure. Our trips are not recommended for individuals who are pregnant or have severe heart or back conditions.

  • Limitation of Liability: To the maximum extent permitted by law, Adventure Fishing Lanka, its owners, Captains, and crew shall not be held liable for any personal injury, death, property damage, or loss sustained by guests during the charter, except in cases of gross negligence.

6. Catch Policy

  • Regulations: All fishing activities will strictly adhere to Sri Lankan maritime laws and local fishing regulations.

  • Catch and Release: We actively encourage catch-and-release, especially for billfish (Marlin, Sailfish) and vulnerable species, to promote conservation.

  • Fish Ownership: Any fish legally kept is distributed at the discretion of the Captain according to local customs [Modify this if guests are explicitly allowed to keep their entire catch].

7. Intellectual Property

Unless otherwise stated, Adventure Fishing Lanka owns the intellectual property rights for all material on the website, including text, logos, and images. You may not republish, sell, reproduce, or duplicate content from this website without our express written consent.

These Terms and Conditions shall be governed by and construed in accordance with the laws of Sri Lanka. Any disputes arising out of these terms or your trip shall be subject to the exclusive jurisdiction of the courts of Sri Lanka.
